Aesthetics and communications theories are often applied to art, media and popular culture but not within legal empirical (audiovisual) material—despite the fact that a judicial and legal process comprises a palpable utilisation of the visual as evidence of an historical reality. Based on four distinct Swedish cases, this study analyses the court’s reasoning, interpretation and use of (audio)visual evidence. Inspired by an embodied film theory, Benjamin’s thoughts on the technical-dramaturgical components of the camera and the later Barthes’ notion of the (...) ‘punctum’, the article discusses how (audio)visual evidence cannot be disconnected from affective and aesthetic significances that ultimately can be taken to affect the perception of truth and (the crime’s) reality. The gap between theory and practice is debated and argued as beginning to co-exist; instead of seeing (visual) theory and (judicial) practice as a dichotomy, an attempt should be made for a conversation between seemingly different but in practice related areas of knowledge. The author’s aim is to suggest that photographic and filmic evidence has a particular significance in itself, which means that the relation between (judicial) interpretation and outcome should be considered within an affective and aesthetic dimension, rather than being placed and/or theorized outside of it. El presente trabajo estudia las diferentes figuras bajo las que aparece Dios en la Crítica de la razón pura de Kant. Estas figuras son: (1) el Dios de la metafísica, teóricamente cognoscible; (2) un Dios capaz de conocer las cosas en sí mismas; (3) Dios como una idea de la razón central para la actividad científica; y (4) un Dios asociado al ámbito práctico. Luego de presentar estas 4 figuras, se examinan sus relaciones, con el objetivo de mostrar que es (...) tan inexacto concebir la postura kantiana sobre el tema de Dios como atea, como pensar que, de manera incoherente y por mero conservadurismo, acaba dándole un lugar a Dios dentro de su sistema. Como conclusión, se examina de qué manera el tratamiento del tema de Dios ilustra la posición kantiana en relación a la metafísica. (shrink)

Currently, the concept of engagement is crucial in the field of learning and school achievement. It is a multidimensional concept (e.g., behavioral, emotional, and cognitive dimensions) that has been widely used as a theoretical framework to explain the processes of school engagement and dropout. However, this conceptual framework has been scarcely used in the field of homework. The aim of the present study was to analyze the role of intrinsic motivation, perceived homework utility, and personal homework attitude as precursors of (...) student homework engagement (behavioral engagement) and, at the same time, how such engagement is the precursor of academic achievement. Seven hundred and thirty students of Compulsory Secondary Education (7th to 10th grade) from fourteen schools northern Spain participated. A structural equation model was elaborated on which intrinsic motivation, perceived utility and attitude were observed variables, and student engagement (time spent on homework, time management, and amount of teacher-assigned homework done) and academic achievement (Mathematics, Spanish Language, English Language, Social Science) were latent variables. The results reveal that (i) intrinsic motivation is a powerful precursor of student behavioral engagement (also perceived utility and attitude, although to a lesser extent) and (ii) academic achievement is closely linked to the level of student engagement, qualifying the results of many of the previous studies conducted from a task-centered perspective (as opposed to a person-centered perspective). The interest of assigning homework is frequently discussed due to its alleged low impact on student achievement. One of the current lines of research is to emphasize the quality of student homework engagement rather than the amount of time spent on homework. The aim of this study was to determine (a) the extent to which students’ prior achievement affects their homework engagement (i.e., time spent, time management, and amount of teacher-assigned homework done), and (b) how students’ intrinsic motivation towards homework (...) may mediate or moderate the relationship between prior achievement and the homework engagement variables. A large sample of students from the first four years of Secondary Education (N = 1899) completed questionnaires. The results showed that intrinsic motivation partially mediates, but does not moderate, the effect of prior achievement on the three variables related to homework engagement (time spent, time management, and amount of teacher-assigned homework done). These results highlight the importance of considering both students’ current level of achievement and their motivation towards homework engagement when assigning homework. (shrink)

‘Interactional expertise’ is developed through linguistic interaction without full scale practical immersion in a culture. Interactional expertise is the medium of communication in peer review in science, in review committees, and in interdisciplinary projects. It is also the medium of specialist journalists and of interpretative methods in the social sciences. We describe imitation game experiments designed to make concrete the idea of interactional expertise. The experiments show that the linguistic performance of those well socialized in the language of a specialist (...) group is indistinguishable from those with full blown practical socialization but distinguishable from those who are not well socialized. The imitation game can also be used to indicate whether an individual can enter an esoteric domain and master the interactional expertise, a skill required by interpretative sociologists of science, anthropologists, ethnographers, and the like.Keywords: Expertise; Interactional expertise; Imitation game; Turing test; Colour blindness; Interpretative methods. We present the findings of a worldwide survey that was administered to business ethic scholars to better understand journal quality within the business ethics academic community. Based upon the data from the survey, we provide a ranking of the top 10 business ethics journals. We then provide a comparison of business ethics journals to other mainstream management journals in terms of journal quality. The results of the study suggest that, within the business ethics academic community, many scholars prefer to publish (...) in the top business ethics academic journals over other mainstream management journals. Furthermore, the results of the study suggest that within the business ethics academic field there are two dominant academic communities: one in Europe and one in North America. Each of these academic communities has its own preferred publication outlets, suggesting a potentially problematic bifurcation of business ethics scholarship. (shrink)

We explore the possibility and some potential payoffs of using the theory of accessible categories in the study of categories of logics. We illustrate this by two case studies focusing on the category of finitary structural logics and its subcategory of algebraizable logics.

Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. This article discusses the mathematizing of the chemical periodic system as a grid, which leads to a quadratic function or “binódica function” formed by pairs of periods or binodos. We describe the periodic law as an increasing function of the principal quantum number. It works subject to the dialectical laws that generate; first: gradual quantitative changes:, with “duplication” of periods:. Second: radical quantitative changes:, with the emergence of new quantum transitions, growth and a change in the format of the binodos. (...) We use analytical and graphic methods to mathematize Mendeleev’s law, making the size of the binodos and the continuous series depend on the number of the binode, which is the same quantum number. In a seminal work, Tversky and Kahneman showed that in some contexts people tend to believe that a conjunction of events (e.g., Linda is a bank teller and is active in the feminist movement) is more likely to occur than one of the conjuncts (e.g., Linda is a bank teller). This belief violates the conjunction rule in probability theory. Tversky and Kahneman called this phenomenon the “conjunction fallacy”. Since the discovery of the phenomenon in 1983, researchers in psychology and philosophy (...) have engaged in important controversies around the conjunction fallacy. The goal of this paper is to explore the most important of these controversies, namely, the controversy about the nature of the conjunction fallacy. Is the conjunction fallacy mainly due to a misunderstanding of the problem by participants (misunderstanding hypothesis) or is it mainly due to a genuine reasoning bias (reasoning bias hypothesis)? A substantial portion of research on the topic has been directed to test the misunderstanding hypothesis. I review this literature and argue that a stronger case can be made against the misunderstanding hypothesis. Thus, I indirectly provide support for the reasoning bias hypothesis. (shrink)

Em busca de possíveis aproximações com o homem contemporâneo e a cultura atual e buscando possibilidades para futuros estudos, que este artigo pretende analisar o moderno fenômeno de ódio expresso nas redes sociais virtuais sob a ótica da moral do ressentimento nietzschiana. A motivação para essa investigação e estudo se deve ao crescimento do fenômeno de ódio na atualidade e que tornou a internet um campo propício para diversos ataques em que, por vezes, determinado perfil de usuário expressa um discurso agressivo predominado pelo ódio. Research has consistently shown that people consider harmful side effects of an action more intentional than helpful side effects. This phenomenon is known as the side- effect effect (SEE), which refers to the influence of moral considerations in judgments of intentionality and other non-moral concepts. There is an ongoing debate about how to explain this asymmetric pattern of judgment and the psychological factors involved in it. It has been posited that affective reactions to agents that bring about harmful side- effects (...) could bias intentionality attributions in these cases, explaining the asymmetric pattern of intentionality judgments that we observe in the SEE. We call this the affective bias hypothesis (ABH). Evidence for the ABH is mixed, with some findings suggesting a role for affective processes, while others suggesting that affective processes play no role in the SEE. A possible explanation for these apparently contradictory results points to affective processes involved in the SEE being confined to anger. In a series of empirical studies, we systematically measured and manipulated participants’ anger in order to test this possibility. Our findings suggest that anger play no role in intentionality judgments in SEE cases, while providing support for a non-emotional motivation to blame as a factor underlying the SEE. (shrink)

I argue that Derrida’s reading of Heidegger in _Geschlecht III_ needs to be situated within the philosophico-political context of Derrida’s 1984–85 seminar—given under the general title _Philosophical Nationality and Nationalism_—from which _Geschlecht III_ is extracted. In the first part of the paper, I reconstruct (...) Derrida’s general problematic of national-humanism as he lays it out in the opening sessions of the seminar, before arriving at his reading of Heidegger, who will be part of “a sequence of German national-philosophism,” as Derrida calls it. In the second part, the paper turns explicitly to _Geschlecht III_ where, as I show, Derrida’s thoroughgoing denunciation of a national-humanism in Heidegger becomes all the more telling when seen through the theoretical matrix of the seminar. Abstract This paper reports the results obtained in an aid project designed to improve transport in the municipal area of Jocotán (Guatemala). The rural road network of an area occupied by indigenous people was analysed and a road chosen for repair using the labour-intensive method–something never done before in this area. The manpower required for the project was provided by the population that would benefit from the project; the involvement of outside contractors and businesses was avoided. All payment for labour (...) went into the pockets of the local people. The small earth movements made and the use of local materials guaranteed the project’s environmental sustainability, while the on-site training of the local community prepared its members for the continued maintenance of the road, thus investing the project with social sustainability. The paper identifies three recent lines of interpretation of the politics that can be derived from Deleuze and Guattari, all of which share a way of reading the dualisms in their work that can be traced back to how they understand the actual/virtual partition, and to an alleged pre-eminence of the virtual over the actual. It is argued that this reading is not only inaccurate, but obscures the political dimension of Deleuze and Guattari's work. Clarifying the latter requires a reinterpretation (...) of the dualisms involved (as dyads rather than binaries), of the relation between virtual and actual (as a formal distinction where one acts back upon the other), and the drawing of a clear distinction between what Deleuze calls a ‘transcendent exercise’ of thought and sensibility and the properly metaphysical exercise that sets up the distinction between virtual and actual. What then appears is an image of Deleuze's and Guattari's thought that is far more concerned with practical questions and with a situated political practice of intervention. (shrink)

I propose and defend the conjecture that what explains why Gettiered subjects fail to know is the fact that their justified true belief depends essentially on unknown propositions. The conjecture follows from the plausible principle about inference in general according to which one knows the conclusion of one’s inference only if one knows all the premises it involves essentially.

It is generally assumed that emotion concepts are purely descriptive. However, recent investigations suggest that the concept of happiness includes information about the morality of the agent's life. In this study, we argue that normative influences on emotion concepts are not restricted to happiness and are not about moral norms. In a series of studies, we show that emotion attribution is influenced by whether the agent's psychological and bodily states fit the situation in which they are experienced. In daily academic life, students are exposed to a wide range of potentially stressful situations which could negatively affect their academic achievement and their health. Among the factors that could be weakened by academic stress, attention has been paid to expectations of self-efficacy, which are considered one of the most important determinants for student engagement, persistence, and academic success. From a proactive perspective, research on academic stress has emphasized the importance of coping strategies in preventing harmful consequences. In recent years, (...) there has been a growing interest in discovering the extent to which individuals are able to combine different coping strategies and the adaptive consequences this flexibility entails. However, studies using this person-centered approach are still scarce in the academic context. On that basis, this current study had two objectives: (a) to examine the existence of different profiles of university students based on how they combined different approach coping strategies (positive reappraisal, support seeking, and planning); and (b) to determine the existence of differences in general expectations of self-efficacy between those coping profiles. 1072 university students participated in the study. The coping profiles were determined by Latent Profile Analysis (LPA). The differences in the self-efficacy variable were determined using ANCOVA, with gender, university year, and degree type as covariates. Four approach coping profiles were identified: (a) low generalized use of approach coping strategies; (b) predominance of social approach coping approaches; (c) predominance of cognitive approach coping approaches; (d) high generalized use of approach coping strategies. The profile that showed that a greater combination of the three strategies was related to higher general self-efficacy expectations, and vice versa. These results suggest that encouraging flexibility in coping strategies would help to improve university students’ self-efficacy. (shrink)

This paper tracks Derrida’s allusion to the “phoenix motif” in the recently published Life Death seminar, showing how it foreshadows and overlaps with the political problematic of “national humanism” made explicit in Geschlecht III. I argue that, be it in Hegel, Fichte, Nietzsche, or Heidegger, biological life is always in the service of a spiritual life that finds its breath in a certain reappropriation of the German idiom. Following Derrida, I argue that this “philosophy-of-life German” introduces a sinister equivocality between (...) these thinkers and National Socialism, and this in spite of all their prudence to shield their discourses from such a co-option. Interpersonal relations play a critical role in both the conception and dynamics of Brazilian citizenship. Under the influence of neoliberalism, patients must build strategies to access high‐quality health care services. This study aimed to analyze the role of interpersonal relations involved in the access to and delivery of health care services in Brazil amid the influence of austerity policies and the role of nurses in enhancing citizenship through nursing care. Thirty‐one patients in a public hospital in Rio de Janeiro, Brazil, (...) participated in qualitative interviews. A lexical analysis was conducted to analyze the interview data using Alceste® software, version 2012. The results were interpreted in light of both theoretical constructs of the Brazilian citizenship and biological subcitizenship propositions. Two lexical classes revealed contents about strategies used by patients to access high‐quality health care. In the context of budget cuts due to austerity policies, cultural aspects of Brazilian citizenship have influenced access to high‐quality health care services by creating two distinct conditions. Some patients acted as super‐citizens, while others acted as subcitizens. Nurses across the globe must spearhead the struggle for universal and equitable health care access at all levels, without losing sight of wider sociocultural aspects. (shrink)

The approach introduced in this paper bases on Marx´s criticism of Hegel in order to explain which determinations of capitalism allow Hegel to describe the general forms of the dialectical method. We affirm that, since capital has an automatic movement, Hegel supposes that the conscience, which realizes this movement, sets itself in motion. Nevertheless, following Marx we argue that Hegel clarifies the basic structure of the dialectical method, i. e., the affirmation through self-negation of every real form.

This article presents an interpretation of Cyrus’ psychology in Xenophon'sCyropaedia. Its point is that Cyrus’ psychological structure is composed by a set of three desires (philotimía, philanthrōpía, philomátheia) given by nature and a set of virtues (sōphrosúnēandenkráteia) acquired by education. The paper will argue that Cyrus, as an enkratic ruler, does not long for any kind of honours, but is guided by truephilotimía, that is, the desire for true honours—honours freely given by gratitude or admiration.philanthrōpíais the key to achieve these (...) honours, since it naturally prompts a benevolent and generous behaviour. At the same time,philomátheiaprovides the desire of knowledge necessary to acquire the techniques in order to accomplish ambitious and philanthropic deeds. Therefore, confronting those who have posed negative interpretations of Cyrus, the article will argue that the uncommon combination of these psychological predispositions makes Cyrus a virtuous and effective ruler. In a recent paper in this journal, David Chalmers introduced the meta-problem of consciousness as “the problem of explaining why we think consciousness poses a hard problem” (Chalmers, 2018, p. 6). A solution to the meta-problem could shed light on the hard problem of consciousness. In particular, it would be relevant to elucidate whether people’s problem intuitions (i.e. intuitions holding that conscious experience cannot be reduced to physical processes) are driven by factors related to the nature of consciousness, or rather (...) by factors that are independent of consciousness. Whether people hold problem intuitions, and what factors drive those intuitions, are largely empirical questions. However, there is a lack of empirical research on these issues to date. The results of four studies will show that (1) problem intuitions are not widespread, and (2) when they arise, they do so because of factors that are unrelated to the nature of consciousness. This suggests that consciousness is, after all, not so problematic. (shrink)

This article attempts to read the very concept of reading as articulated and problematized by Derrida’s newly discovered Geschlecht III. I argue that Derrida enacts a reading of Heidegger in Geschlecht III in ways that help us understand the strong sense Derrida gives this word. In the article’s first part, I dwell on Derrida’s—and Heidegger’s—methodological precautions that problematize the traditional concept of reading so as to open the way for a reading of Heidegger that does not bank on the metaphysical (...) presuppositions the very same Heidegger warns us against time and again. In the second part, I turn to Derrida’s topotypological examples that show us what traditional methodology problematically presupposes when “reading” Heidegger. The article ends by turning to the Derridean notion of “overprinting”—and the uncanny effects of doubling it implies—as a way to think about what it means to read and countersign Heidegger’s text. Nuestra pregunta será: ¿cómo comprender al estructuralismo? ¿Cómo indicar sus límites cuando se trató de un conjunto de propuestas teóricas que atravesó disciplinas, que sufrió cruces con diversas teorías y cuyas premisas nunca fueron establecidas con claridad? A partir del concepto de problemática, desarrollado por Althusser fundamentalmente en La revolución teórica de Marx, se nos abrirá la posibilidad de interrogar al conjunto de propuestas teóricas que lo (...) conformaron, no tanto como un canon aplicable a las más diversas materias sino como un espacio teórico atravesado por contradicciones. Así, nos apoyaremos en la noción de problemática porque la consideramos particularmente fértil para pensar un campo teórico más como un conjunto de problemas y preguntas que como un compendio de respuestas a dificultades teóricas claramente delimitadas.Pretendemos destacar las contradicciones que vertebran al estructuralismo porque nos conducirán a plantear que es posible emplazar una distancia en su interior, distancia que mostrará como una de sus variantes aquella que afirma la imposibilidad de pensar una estructura de estructuras final que las totalice a todas. If we want to say what “fundamentality” means, we have to start by approaching what we generally see at the empty place of the predicate “____ is fundamental”. We generally talk about fundamental entities and fundamental theories. At this article, I tried to make a metaphysical approach of what is for something to be fundamental, and I also tried to talk a little bit of fundamental incomplete and complete theories. To do that, I start stating the notion of “entity” and (...) looking at the difference at perceived entities. The difference led us to talk about the entities’ structures and their powers, and about the supervenience between these last two. The supervenience talk made us to see the fight between emergentism and reductionism as the difference between the irreducibility of laws and the reducibility of powers and structures to lower-order domains. La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. In “Is Justified True Belief Knowledge?” Edmund Gettier (1963) attacked the thesis ‘S knows that P iff P is true, S believes that P, and S is justified in believing that P’. His intention was to sustain that someone can have a justified true belief without knowing that belief. He made that by creating two counter-examples to that thesis. In this article, I try to show that Gettier’s arguments are based in a weak account of justification, and that such a (...) weak view cannot talk about someone knowing something. Resumen: El artículo pretende desarrollar una serie de argumentos descriptivos que indaguen en torno a la relación que puede establecerse entre el sentido de ser cuerpo y la re-significación que puede asumir su expresión contemporánea desde la noción de excritura, propuesta por el filósofo francés Jean-Luc Nancy. Si hay pensamiento es porque hay un sentido que siempre nos da que pensar algo. Al entender aquello, la comprensión definida tradicionalmente desde las formas explicativas y estructuralmente racionales se transforma en un estar (...) ahí sensible de manera diferente a los modos racionales aprendidos culturalmente. Para la deconstrucción, el sentido vendría a ser aquel tocar proveniente desde una exterioridad no pensable. Al pensar de otra manera, siempre estaremos en el límite de nuestras condiciones, ya sea por las formas en que hemos construido nuestras relaciones productivas o simplemente por nuestra existencia en el mundo. Lo que toca desde la exterioridad no pensada, es justamente, el sentir en tanto una llamada a estar en dicha afección, en el extrañamiento de tener una sensación afectiva. La excritura en este contexto se enfrenta al pensamiento como confrontación permanente de significaciones históricas y relativizadas culturalmente.: This article aims to develop a series of descriptive arguments that explore the relationship that can be established between the sense of being of a body and the re-signification which can assume its contemporary expression from the notion of concealed thinking proposed by the French philosopher Jean-Luc Nancy. We could argue that if there is thought it is because there is a meaning that always gives us something to think about. Once we understand this, the comprehension traditionally defined from the explanatory and structural rational forms, it is transformed in a “being there”, in a sensible and different way to the cultural and rational modes culturally learned. For its deconstruction, the sense what become that touching coming from a non-thinkable exteriority. If you want to think differently, we are always at the limit of our conditions, either because of the ways in which we have built our productive relationships or simply because of our human way of being in the world. What touches from the “not thought exteriority”, is precisely, the feeling as a call to be in that affection -a sort of appropriation of meaning-, in the estrangement of having an affective sensation. Concealed thinking in this context faces the thought as permanent confrontation of historical meanings and culturally relativized. (shrink)
